The following official rules apply to the conduct of the Face of My68 Casting Call.
NO PURCHASE NECESSARY.
1. ENTRY DEADLINE: The contest starts on April 18, 2008 , and all requested information must be received by the Station by 5:00 p.m. on May 28, 2008 .
2. ELIGIBILITY: To be eligible to participate in this contest, entrants must be U.S. residents who reside in the WABM viewing area, be 21 years of age or older, have a high school degree, no felony convictions, clean driving record, reliable references, and if chosen to be a finalist must pass a drug test and background check.
Employees of Sinclair Broadcast Group, Inc., Sinclair Television Group, Inc., WTTO, Inc. and any other company which owns, programs or provides other services to television broadcast station WABM-My68 (the “Station”), Buffalo Rock, Pepsi, Virginia College, Club Quincy, their affiliated companies, advertising and promotion agencies, any and all local television broadcast and cable stations, local radio and other media companies, and the immediate family members of each are ineligible. The term “immediate families” includes spouses, grandparents, parents, siblings, children and grandchildren.
Entrants must not be a member if SAG, AFTRA or any other union, or presently under contract with another media company, talent agency, or represented by any talent agency.
3. HOW TO ENTER:
a) To enter go to WABM's website www.wabm68.com and download the online entry form. Send the completed entry form (including the initialed sample independent contractor agreement), and a three minute DVD/VHS video of why you should be the Face of My68 to “Face of My68” WABM, 651 Beacon Parkway, West, Suite 105, Birmingham, AL 35209.
b) The Station is not responsible for lost, late, or misdirected mail, computer, electronic malfunctions or for printing errors.
c) Limit of one entry per person. All entries (including all DVD's and videotapes) become the property of the Station and will not be returned.
d) By entering, entrants represent that the video submitted as part of the entry is the original work of the entrant and does not violate any third parties.
e) Any video which appears to include potentially harmful or lewd acts will be disqualified and may be reported to the appropriate authorities at the discretion of Station management.
4. JUDGING OF ENTRIES AND LIVE APPEARANCE:
a) All eligible contestants' video entries will be reviewed by Station's General Manager and Production Manager and shall be judged according to the following criteria and with the following weight given to each such criterion: 1) Technique (60%); 2) Stage Presence (20%); and 3) Originality (20%). This panel will choose five (5) finalists by May 30, 2008 .
b) On or about May 30, 2008 the five finalists will be notified by phone. If a finalist cannot be reached by phone or mail within five (5) days from the first notification attempt, then such finalist will be disqualified and another finalist with the next highest score will be chosen in his/her stead. Based on successfully completing a background check and drug test, the five finalists must arrive to perform at Club Quincy on June 6, 2008 at 6:00 p.m. and once again will be judged on the following criteria and with the following weight given to each such criterion: 1) Technique (40%); 2) Stage Presence (40%); and 3) Originality (20%). A panel of approximately 4-6 judges will choose one winner, which will be announced on June 6, 2008 at Club Quincy.
c) In the event of a tie, the finalist with the highest score in the judging criterion set forth in section 4(a) will be declared the winner. The winner will be notified in person on June 6, 2008 . If the winner forfeits the opportunity, the judges may (but are not required) consider another finalist as the winner. The decisions of the judges are final.
d) Once the winner is chosen, he/she will be offered the opportunity to be the Face of My68 program subject to the conditions set forth in Section 5 of these rules.
5. DUTIES AND CONDITIONS OF THE FACE OF MY68 (“CONTRACTOR”)
Subject to the terms and conditions of the Independent Contractor Agreement (the “Agreement”) (a copy of which was provided to all entrants at time of entry), the winner(s) will agree:
a) to perform services for Company as “The Face of My68” for the Station and to perform such duties and assignments, including, without limitation, public relations activities connected with promoting the Station and himself/herself as a personality identified with the Station, as are directed by Company in Company's sole and absolute discretion;
b) to render the above described services exclusively for Company and not render any such services to any person or entity other than Company without the prior written approval of the General Manager of the Station, which approval may be withheld in his/her sole and absolute discretion. Winner will not authorize or permit the use of winner's name, voice and/or likeness in connection with any activity, except as specifically authorized in writing by the General Manager of the Station.
c) to sign the Agreement, which includes an agreement not to compete within the Birmingham , Tuscaloosa , Alabama designated market area (“DMA”) during the term of the Agreement and for a period of six months year following the termination of the Agreement .
d) that nothing contained herein shall be construed to be a contract of employment; and
e) that Contractor is engaged in an independent business and is an independent contractor. Contractor shall under no circumstances be considered an employee of the Company, nor shall Contractor have any authority to hold himself/herself out or represent (or take any action holding himself/herself out or representing), that he/she is an employee of the Company. The Company shall have no right to, and shall not exercise control over, the manner, mode, means or methods which Contractor uses to perform the services required of Contractor. Contractor and Company agree that Contractor shall not be entitled to any benefits paid or provided under any employee benefit plan available to any of the Company's employees.

7. All eligible contestants acknowledge that WTTO, Inc., Sinclair Broadcast Group, Inc. and Sinclair Television Group, Inc. have the right to publicize your name, character, likeness, photograph, and voice for promotional purposes without financial remuneration.
8. This contest is subject to all applicable laws and regulations and is void where prohibited. WTTO, Inc., Sinclair Broadcast Group, Inc. and Sinclair Television Group, Inc. accept no responsibility or liability in connection with any injuries, losses or damages of any kind caused by or resulting from the contest or the acceptance, possession or use of any prize awarded hereunder.
9. Station cannot be held liable for any lost or stolen entries or information
10. Station reserve the right to make rules and contest changes and change the aforementioned contest dates.
